J.J. Terry's Enrollment as an Intermarried Citizen

Intermarried

    In the matter of the application of Jefferson J. Terry for enrollment as an intermarried citizen of the Choctaw Nation. Jefferson J. Terry being first duly sworn testified as follows:

Examination by the Commission:

Q    What is your name? 
A    Jefferson J. Terry.

Q    How old are your?   
A    Fifty-five.

Q    What is your post office address?  
A    Hugo.

Q    How long have you been a resident of the Choctaw Nation?   
A    About eighteen years.

Q    Have you lived here continuously for the past eighteen years?  
A    Yes sir.

Q    Did you ever make your home anywhere else during that time?   
A    No sir

Q    Do you claim intermarried rights in the Choctaw Nation?   
A    Yes sir.

Q    What is the name of your Choctaw wife through whom you claim these rights?  
A    Josephine Hickman.

Q    Is she a recognized and enrolled citizen of the Choctaw Nation?   
A    Yes sir.

Q    Have her rights to enrollment ever been disputed?   
A    No sir.

Q    When were you married to Josephine Hickman?    
A    In ’98, October.

Q    Where was this marriage ceremony performed?    
A    Goodland, I. T.

Q    At that time were both you and she bona fide residents of the Choctaw Nation?
A    Yes sir.

Q    Were you married in accordance with the Choctaw tribal law?  
A    Yes sir.

Q    Did you obtain a marriage Licenses?   
A    Yes sir.

Q    From whom did you get that license?   
A    County Clerk, J. L. Burney I believe.

Q    Of what county?  
A    Kiamitia.

Q    How much did you pay for that license?   
A    $100.  

Q    Who performed the marriage ceremony?  
A    Parson Hodges.

Q    Were you ever married prior to your marriage to Josephine Hickman?   
A    Yes sir.

Q    How many times?   
A    Twice.

Q    What was the name of your first wife?   
A    Phoebe McKeever.

Q    When were you married to her?    
A    ’77.

Q    How long did you live with her?    
A    Six years.

Q    Until her death, or did you separate?    
A    Died with the yellow fever.

Q    What was the name of your second wife?    
A    Dora Payton.

Q    When were you married to her.  
A    In ’90.

Q    How long did you live with her?      
A    Lived with her six years.

Q    Were both of these woman White women?   
A    Yes sir.

Q    Was your wife Josephine Hickman ever married before her marriage to you?  
A    Yes sir.

Q    How many times was she married?   
A    Twice.

Q    What was the names of her former husbands?  
A    Frank Ervin was the first one.

Q    The next one?   
A    Jimmie Hickman.

Q    Where both of these men dead at the time of your marriage to her?   
A    No sir.

Q    Neither one of them dead?   
A    No sir.

Q    She was separated form both of them was she?    
A    Yes sir.

Q    Was she divorced from both of these men?    
A    Yes sir.

Q    Where did she obtain the divorce from Frank Ervin?   
A    Alikchi I believe.

Q    Tribal courts?   
A    yes.

Q    When was that divorce granted?  
A    ’95 I think.

Q    Where was she divorced from the second husband?   
A    Jimmie Hickman?  At Alikchi.

Q    When was that divorce granted?  
A    In ’97 I think.

Q    Have you got  any evidence of her divorce from these two men?   
A    I have one: the second one, Jimmie Hickman, has been lost: the judge that granted that divorce is here, he can testify to that part of it himself.

Q    Who was the Judge?   
A    Judge Everidge.

Q    Since your marriage to Josephine Hickman have you lived together continuously as husband and wife up to the present time?    
A    Yes sir.

Q    There has been no separation, abandonment or divorce?   
A    No sir.

Q    Are you at present living together as actual and bona fide residents of the Choctaw Nation ?   
A    Yes sir.

    Albert G. McMillan being first duly sworn states that as stenographer to the Commission to the Five Civilized Tribes he reported the proceedings had in the above entitled cause on the 3^rd day of December, 1902, and that the above and foregoing is a full, true and correct transcript of his stenographic notes taken in said.
