Man Killed As He Broke Into A Store Here

An unknown man, apparently about 60 years old, was shot and killed by Henry Womack about 11 o'clock Monday night after he had broken into the Daney & Calder second-hand store just west of the railroad on the West Main street.

Womack, who works in the store, was sleeping in the back, and was awakened by the sound of breaking glass. He caught sight of a man just inside of the back window of the store and fired twice, one shot taking effect under the left arm of the man and coming out under the right arm, killing him almost instantly.

The dead man is of medium height and would weigh about 145 pounds. His right arm had been amputated at the shoulder. He was almost completely bald, having only a fringe of grey hair. Womack has only one leg.

Numbers of people looked at the body as it lay in Senner's undertaking parlor Tuesday, but non could identify him, although several remembered seeing him on the streets Monday. One man saw him go into the Daney & Calder store Monday.

He was unarmed when killed and it is supposed that he broke into the store with the intention of stealing.

The examining trial of Womack was held before Justice of the Peace L. W. Oaks at 10 o'clock Tuesday morning and on the motion of R. E. Stephenson, assistant county attorney, he was discharged, the facts showing that he was justified in his act.
